Beginning May 25, 2018, Regulation 2016/679/EU on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter the „Regulation”) will be applied by all European Union member states. This Regulation aims to create a unitary and uniform legislative framework throughout the European Union that will no longer require national implementation measures.

2. YOUR PERSONAL DATA THAT WE PROCESS. PURPOSE. BASIS. PROCESSING DURATION

We collect only the personal data from you that is necessary for us to provide you with the possibility of using our website, to fulfill your orders, to give you access to our products, and to keep you informed about our products, services, and offers (direct marketing), to the extent permitted by legal regulations or with your consent.

CREATING AN ACCOUNT

When creating a user account on our website poem.store, we request and collect your first name, last name, address, phone number, email address, and IP address.

This personal data is necessary for us for pre-contractual purposes, to allow you to access our products, and to place an order, with the legal basis for processing being contractual obligation. If you do not agree to the processing of your data, SC ATELIERELE POEMI SRL will not be able to fulfill and deliver your orders.

Your personal data will be kept for the entire duration of your account, until the account is deleted, but no longer than 3 years from the date of your last login or last order. We will notify you before closing your customer account and deleting all data associated with that customer account. If you placed an order after creating your account, your data will be kept for 3 years from the date of your last order, as this is the statute of limitations.

Your data processed at the time of account creation will not be subject to a decision based solely on automatic processing, including profiling, will not be disclosed to any third party, and will not be transferred to a third country or international organization.

PLACING AN ORDER

When completing and finalizing the order form, we request and collect your first name, last name, contact address, delivery address, phone number, and email and IP address.

This personal data is necessary for contractual purposes, in order to fulfill your orders, deliver the products to the indicated address, fulfill our warranty obligations associated with the products, or, as the case may be, to process product returns. The basis for processing is the contractual obligation between the parties as established by the Terms and Conditions. To the extent you do not agree with the processing of your data, SC ATELIERELE POEMI SRL will not be able to fulfill and deliver your orders.

Additionally, your personal data is necessary for us to complete and deliver the tax invoices for the products delivered. Your online payment data will not be accessible or stored by SC ATELIERELE POEMI SRL, but only by the electronic payment service provider or another entity authorized to provide card identification data storage services, whose identity you will be informed about prior to actually entering the card details you use for online payment. The only payment-related data we will store are those related to the initiation and completion date of the transaction, as well as the payment status. Based on legal obligation, your personal data necessary for the preparation of payment documents will be provided to our contractual partners who provide us with IT services and will be used for the purpose of submitting tax and accounting declarations to the fiscal authorities.

Your personal data will be kept for the entire duration of the contractual relationship and for a period of 3 years from the date of your last order, this being the statute of limitations.

To be able to perform our obligations on time and as agreed, your personal data will be disclosed to our trusted contractual partners, carefully selected:

  • provider of external server data storage services located in Romania
  • accounting service provider
  • communications and correspondence transmission service provider via email
  • the mobile service provider that helps us stay in touch with you, located in Romania
  • couriers with whom we have a contractual relationship
  • online payment service processors

The data of yours processed at the time of account creation are not subject to a decision based exclusively on automated processing, including profiling, and will not be subject to a transfer to a third country or an international organization.

NEWSLETTER – DIRECT MARKETING

Subscribing and unsubscribing to SC ATELIERELE POEMI SRL newsletter is free and voluntary, and is done exclusively based on your consent. The newsletter is a means of periodic, exclusively electronic (email, SMS) information about the Seller's Goods, Services, Promotions, etc. during a certain period, without any commitment from the Seller regarding the information contained therein.

To ensure marketing services, we collect your email address, phone number, last name, and first name. This data will be used exclusively to keep you updated on our products, services, and offers. The basis for processing personal data is your consent, and the data will be processed for the entire duration of your consent.

Consent can be withdrawn at any time by sending an email to [email protected] or by accessing the unsubscribe link in emails received from us, and will result in the cessation of processing. Withdrawal of consent will not affect the lawfulness of processing carried out before its withdrawal.
